Upscale Auto Sales

On April 28, 2024, I purchased a 2019 Ford Fusion from Upscale Auto Sales LLC after seeing it on Facebook Marketplace. We were never directed to their website and were not given any written disclosures about the vehicle’s condition beyond the bill of sale, which made no mention of past damage or safety issues. After receiving the vehicle on May 5, the airbag light was on. On May 13, a certified Ford dealership inspection revealed that the airbags had been previously deployed and not replaced, and the seatbelt module was also damaged. The total cost to make the vehicle safe exceeds $6,000. We immediately contacted Upscale Auto Sales, who offered to send airbags — but they sent used parts that the dealership could not install. Further inspection found additional unrepaired safety issues, including glued-together seats with deployed airbags. Despite repeated calls, Upscale Auto did not offer a solution or accept responsibility. They later claimed the damage was listed on their website, which was never provided to us when making the purchase. This vehicle was sold “as-is,” but that does not excuse failing to disclose known safety defects, especially those affecting airbags and seatbelts. This violates the Ohio Consumer Sales Practices Act and puts our family at serious risk.

Actual vehicle price is $3000 more than Cars.com listed price. (A very significant difference) You have to read in the individual vehicle details section to find this out. The extra $3000 is a "down payment amount." As a cash buyer, this is not a valid pricing methodology. This makes searching ads by price ineffective. This also skews the price "good deal" estimator making it invalid. This is not a good indicator of a reputable business.
