I had put a deposit on a car and then they sold it out

I had put a deposit on a car and then they sold it out from under me. Now, to be fair the dealership would say that the person who bought the car was testing driving it when I put the deposit down. And maybe one could argue that a person in store has more right to the car than someone out of state like me but I gave them a $4K non-refundable deposit "to hold the vehicle." But it would seem putting money down does not actually hold the vehicle. The dealership might even respond to this saying "it is their policy to give customers on the show room floor first right of refusal." To be fair that does make a little sense, but what makes more sense is that the first person to put money down on a car gets first right of refusal. They at least called to apologize, but I would rather have the car. And they sent me my "non-refundable" deposit back. But at the end of the day I think this is a terrible business practice. I am in real estate and this same logic would never be allowed in that sector. Let's say you put in your earnest money deposit on a house. The sellers decide to still let prospective buyers see the home, which is their right to do to hopefully secure a back up offer. But in the process they decide they want to sell to someone else. You get screwed out of the house even though you put money down on it. At least in real estate there is a contract the parties must follow, not so in car sales. Turns out they can make up the rules as they go to secure a sale at the expense of doing what is right.

Leased a new vehicle. The staff was super helpful and worked diligently to prepare a deal and are super knowledgeable and courteous. Will recommend this dealership to anyone any day!

Mercedes of Nashville has such a beautiful showroom, with plenty of different models on display. My salesman, Hasan, was excellent. He listened carefully to what I wanted, and was able to narrow down to the right model for me quickly. As a single woman, I found it an easy and very comfortable sales experience, and recommend it.

The entire staff were amazing! So helpful and friendly! Autumn was so amazing, she walked through all the bells and whistles of my new Mercedes and taught me how to use them! Probably one of the best buying experiences I’ve had.
